GENERAL POLICIES: TERMS AND CONDITIONS OF SERVICE
The operator, owner, and entity responsible for this website is Perú Infinite Travel S.A.C. (hereinafter, PIT), a travel and tourism agency duly incorporated and registered under the laws of the Republic of Peru.
These Terms and Conditions establish the legal framework governing the access, browsing, and use of our websites, as well as the booking and contracting of the travel services and products offered by PIT. By using this platform, consulting its contents, or confirming a reservation, you expressly acknowledge and agree to be fully bound by these conditions in their entirety.
PIT reserves the right to modify, update, or amend these terms and conditions periodically to adapt them to new legal regulations or company commercial policies. Therefore, it is the user’s responsibility to visit this section regularly to stay informed about the changes in effect.
If you do not agree to strictly abide by these terms and conditions, you must immediately discontinue the use of this platform, refrain from accessing its information, and not proceed with the contracting of any of the services that form part of this website.
1. Purpose of the Website
The use of this website shall be exclusively for the user to personally consult the information provided for the purpose of contracting the products or services offered by the organization.
Perú Infinite Travel S.A.C. (hereinafter, PIT) assumes no liability for direct, indirect, consequential, incidental, or any other type of damages arising from or related to the use of the platform by the user, or the information provided or obtained from it.
2. Age Requirements and Supervision
For the valid contracting of travel services, the user must be of legal age. Parents and guardians must continuously supervise minors’ access to our sites and, in particular, the use of any interactive or purchase section.
3. Intellectual Property and Copyright
All intellectual property rights regarding the content of the web pages, their graphic design, trademarks, texts, interfaces, and source codes are the exclusive property of PIT. The creation of copies intended for strictly personal use is authorized only unless otherwise indicated in writing. The modification, reproduction, publication, distribution, or transfer of any content to third parties, as well as its use for commercial purposes—even when citing the sources—is strictly prohibited without the express written consent of PIT. Except to the extent permitted by applicable law, it is strictly forbidden to disassemble, decompile, reverse engineer, or attempt by any means to break the protection of the website’s content.
All trade names, trademarks, logos, distinctive signs, or images that do not belong to the agency correspond to their respective owners, PIT having managed the corresponding authorizations for their inclusion in the digital platforms.
4. Platform Availability
Our websites are made available to the public on an “as is” and “as available” basis. The user acknowledges that the platforms may occasionally be unavailable due to breakdowns, scheduled maintenance, or other causes beyond our control. No warranty of any kind is offered regarding the quality, functionality, availability, or continuous performance of our sites or their content. PIT reserves the right to change, suspend, or withdraw any content, or discontinue any feature of the site at any time and without prior notice. The user is responsible for paying the fees of their Internet Service Provider, as well as any expenses related to the use of and connection to our networks.
5. Update of Travel Information
PIT makes every organizational effort to ensure that the website content is as accurate and truthful as possible; however, due to the dynamic nature of the tourism sector, it could contain inaccuracies, typographical errors, or not be updated in real time. PIT may modify the website content at any time and assumes no commitment to update it within a specific period.
6. Links to Third-Party Sites (Hyperlinks)
PIT is not responsible for the content, privacy policies, security, or practices of other websites linked to or accessible from this platform through hypertext links. Such links are provided solely as an informative reference for the user.
7. Travel Services Contract
    • 7.1 Perfection of the Contract: The confirmation of a booking made in writing (via email, instant messaging), by telephone, electronically (online), or in person constitutes a binding contract between the client and Perú Infinite Travel S.A.C. The contract is governed entirely by these Terms and Conditions. At the latest upon payment of the invoice, advance payment, or prepayment, the client declares acceptance of these terms and gives explicit consent to their content. The client is solely responsible for providing accurate personal data (full names, surnames, passport or ID number, and date of birth) in strict accordance with the information in their valid passport. Furthermore, it is the client’s responsibility, upon receiving an invoice or confirmation, to verify that the information contained therein is complete and correct. Any inaccuracy must be reported immediately to PIT. Operating costs arising from the lack of timely notification shall be borne exclusively by the client.
    • 7.2 Services of Third-Party Providers: Services intermediated by PIT but not directly organized or provided by it (such as airlines, railway companies, cruise lines, or specific hotels) are additionally governed by the terms and conditions of the respective final providers, which are made available to the client before or during the conclusion of the contract.
8. Prices and Payment Conditions
    • 8.1 Payment Terms: Payment shall be made upon receipt of the invoice or confirmation, in accordance with the amounts and deadlines detailed therein. Unless expressly stated otherwise in the confirmation document, the final balance due must be fully settled before the departure date or the start of services.
    • 8.2 Modification of Prices and Rates: PIT reserves the right to adjust the final established prices only in the following exceptional cases:
        • Unexpected price changes applied by transport companies, railway operators, and/or other external providers in the tourism chain.
        • New or increased government taxes, duties, or public charges (for example, variations in the General Sales Tax – IGV, airport fees, security fees, or entry fees to archaeological parks).
        • Obvious and manifest printing, typographical, or publication errors in itineraries and systems.
9. Validity of Booked Services
The contracted travel services are valid solely and exclusively for the dates, times, and specifications indicated in the confirmation invoice and the respective service vouchers.
10. Booking Changes by the Client
Any request for modification of bookings (dates, passenger names, changes of routes, or services) must be requested by the client strictly in writing. PIT will assess the feasibility of the request, which remains subject to the penalties of the final operators and applicable administrative expenses.
11. Cancellation and Refund Policy
    • 11.1 Administrative Expenses: For any voluntary cancellation requested by the client prior to the start of services, a PIT management fee of at least USD 20.00 per person and service shall apply, which will be charged in addition to the cancellation penalties detailed below.
    • 11.2 Scale of Penalties: Unless specific conditions are expressly stipulated in writing for particular programs, the penalty rates for advance cancellations are as follows:
        • Up to 14 days before the start of the tour or trip: No penalty charges apply (only the administrative management fee and financial gateway commissions shall apply).
        • Between 7 and 13 days before the start of the tour or trip: A penalty corresponding to 50% of the deposit or initial payment made.
        • Less than 7 days before the start of the tour or trip (or No Show): A penalty corresponding to 100% of the deposit or the total payment of the service.
    • 11.3 Financial Expenses: Under no cancellation or refund scenario will bank charges, international wire transfer fees, credit card payment gateway fees, or differences resulting from currency exchange rates be refunded.
    • 11.4 Postponements due to Health Reasons: If the trip or tour cannot be started due to health reasons of the holder, duly certified by an official medical certificate issued by a competent authority, the itinerary may be postponed to a later date subject to availability. In this specific case, PIT will not apply its own cancellation charges, and the client must only assume the rescheduling costs required by third-party providers (such as airlines or trains).
    • 11.5 Cancellations due to Force Majeure: If the tour must be mandatorily canceled due to events of force majeure or acts of God (natural disasters, pandemics, transport strikes, social unrest, extreme weather conditions, or government mandates), PIT will not make cash refunds. Instead, the agency will issue a Travel Credit (Voucher) for the net recoverable amount, which may be used for an itinerary on any subsequent date, subject to availability and seasonal surcharges from providers if applicable.
    • 11.6 Interruption of the Trip or Early Return: If the client voluntarily interrupts the trip, leaves the group, or decides to change or not use the agreed services once the itinerary has begun, they shall not be entitled to claim any refund or return. Additional costs derived from the interruption or abandonment shall be entirely borne by the client.
12. Travel Insurance
It is highly recommended that clients purchase a comprehensive travel insurance policy with broad coverage (cancellation expenses, emergency medical care, and travel incidents). By opting not to purchase travel insurance through our channels or externally, the client confirms under their sole responsibility that they have sufficient private insurance coverage to cover accidents, hospitalization, and illnesses abroad. PIT strongly recommends that clients carefully read the general terms and conditions of their insurance prior to departure.
13. Passports, Visas, and Vaccinations
The client is solely responsible for strictly complying with individual passport requirements (with a minimum validity of 6 months upon entering Peruvian territory), consular visas, customs regulations, currency declarations, and mandatory vaccination policies, as well as managing and physically carrying all necessary documents throughout the trip.
14. Complaints, Claims, and Disagreements
If the client detects any deficiency or has grounded reasons to submit complaints during the course of the trip, they must communicate them immediately to the assigned tour guide, the route coordinator, or PIT’s customer service department. This timely communication allows corrective measures to be taken on-site.
    • 14.1 Exclusions of Liability: PIT shall not be held civilly or contractually liable if the breach, delay, or poor fulfillment of the contract is due to:
        • Negligence, omission, or lack of compliance with these Terms and Conditions by the client.
        • Acts or omissions of third parties unrelated to the direct organization of the services.
        • Events of force majeure, acts of God, or events that PIT or a service provider could not have foreseen or avoided, even when acting with due diligence. Therefore, PIT is exempt from liability for variations in the itinerary caused by sector strikes, social unrest, adverse weather conditions, landslides, overflowing rivers, unforeseen decisions taken by government authorities, operational delays of railway or airline companies, among others. In cases of force majeure, PIT reserves the right to modify the itinerary, postpone activities, or cancel specific segments of the trip, focusing primarily on the comprehensive safety of the traveler.
15. Privacy and Personal Data Protection
    • 15.1 Processing of Your Data: PIT needs to collect various personal data from you and the members of your travel group (such as full names, surnames, type and number of identity document, date of birth, nationality, email address, dietary restrictions, or relevant medical conditions) for the proper execution of the travel services contract. PIT will process such personal data in strict compliance with the Personal Data Protection Law (Law No. 29733) and its Regulations. The data will be used to carry out the booked services and will not be transferred to third parties unrelated to the operation, nor will they be used for purposes other than those authorized.
    • 15.2 Transfer to Service Providers and Authorities: PIT will transfer your personal data only to those external travel service providers (hotels, airlines, train operators, guides, and allied local agencies) whose intervention is strictly necessary to process, reserve, and execute the travel contract.
    • 15.3 Legitimate Interests and Legal Requirements: PIT reserves the right to disclose or transfer the corresponding data to the competent public authorities (police, judicial, or administrative) in compliance with current legal regulations, for the prevention of crimes, or for the assertion and defense of the legitimate interests of the company before courts or official bodies.
    • 15.4 Validity and Conservation: The data provided will be kept as long as the contractual and commercial relationship for services is maintained, and subsequently, during the periods legally required by the tax and audit regulations of the Republic of Peru, as stated in our  Data Protection Policy.
